Terms of Service

These Terms govern your use of Healthchart's website, app, and meal-subscription service. By creating an account or placing an order you agree to them. If you do not agree, please do not use the service.

1. Who we are

Healthchart (“Healthchart”, “HealthchartKW”, “we”, “us”) is a Kuwait-based healthy meal subscription operating at healthchartkw.com. Contact details are in section 14.

2. Eligibility & accounts

  • You must have a delivery address in Kuwait and a Kuwait mobile number to receive delivery and verification messages.
  • Cardholder responsibility. The payment method you use must belong to you, or you must have explicit permission from its holder to use it. By submitting a payment you confirm you are authorised to do so and that you accept the charges. If a minor is using the service, a parent or guardian must hold the account and accept these Terms on their behalf.
  • You are responsible for keeping your sign-in details safe and for everything done under your account. Tell us immediately if you suspect unauthorised access.
  • You agree to give us accurate information (name, contact, address, allergies, dietary flags) and to keep it up to date.

3. The subscription service

  • A subscription covers a fixed number of delivery days at a fixed total price in Kuwaiti Dinars (KWD). The plan, duration, and price are shown to you before you pay.
  • Full upfront payment. The full amount for the plan duration is charged when you start the subscription.
  • Auto-renewal is OFF. Your subscription ends on the last delivery day. We will never charge you for a new subscription period without your explicit opt-in.
  • We may from time to time update plan content, menus, prices, or rules. Changes apply from the time we publish them and do not affect a subscription that is already paid and in progress.

4. Daily cutoff & delivery

  • Daily cutoff: 7:00 AM Kuwait time (unless we publish a different cutoff for a specific plan). After the cutoff for a given delivery day, your meals for that day are locked and sent to the kitchen: no swaps, customisations, or skip/pause requests can affect that day.
  • Delivery window: 8:00 AM to 4:00 PM Kuwait time on each scheduled day. We do not guarantee a specific arrival time within the window.
  • Make sure the address on file is correct and reachable on the day. If a delivery fails because the address is wrong, you are not present, you do not answer calls, or access is blocked, that day's meal is treated as delivered and is not refunded unless our investigation shows the failure was our fault.
  • If we fail to deliver because of a kitchen, logistics, or staffing problem on our side, we will either redeliver, credit a replacement day, or refund that day: at your choice and at our discretion case by case.

5. Meal swaps, portions, and customisation

  • You may swap eligible meals and adjust ingredient portions from your calendar at any time beforethat day's 7:00 AM cutoff.
  • Available meals depend on the menu we publish, your plan, and your declared allergies. Some meals or ingredients may not be eligible for customisation.
  • The kitchen plans production around the cutoff snapshot. Late changes are not possible and are not grounds for refund.

6. Pause, freeze, skip

Pause, freeze, skip, and schedule-change requests are handled manually for launch. Contact Health Chart with your subscription reference so the team can review the request case by case.

  • A request can cover a single day or a longer range, depending on the situation and the operational state of the kitchen schedule.
  • Approved handling may be recorded as a schedule adjustment, extension, wallet credit, refund, or no monetary adjustment where appropriate.
  • Public pages do not promise a fixed freeze extension or cash handling outcome for launch.

7. Cancellation & refunds

Customer cancellation is request-only for launch. Contact Health Chart with your subscription reference. Refunds and operational adjustments are reviewed manually case by case; we do not publish a public pro-rata formula or an exact refund preview. See our Refund Policy, which forms part of these Terms, for the current manual review process.

8. Allergies, dietary needs, and medical disclaimer

Healthchart provides general healthy meals. We are not a medical service and we do not give medical, nutritional, or clinical advice. The macros, ingredients, and allergens published for each dish are our best information at the time, but the kitchen handles many ingredients in a shared environment and we cannot guarantee that any meal is completely free of any specific allergen.

  • You must declare your allergies and food dislikes in your profile so the meals you are offered respect them.
  • If you have a diagnosed medical condition, dietary restriction, or food allergy with serious health implications, please consult your physician before subscribing and confirm individual meals with us before consuming them.
  • Pregnant or nursing customers should review meal choices with their physician.

9. Pricing, taxes, and payment

  • All prices are quoted in Kuwaiti Dinars (KWD) and include any applicable taxes.
  • Checkout uses the available payment gateway when it is enabled. If online checkout is unavailable, our team confirms the safest manual payment route. Card details are entered only on the hosted gateway page when that flow is available and are not stored by us.
  • If a payment is returned or proven fraudulent, we may suspend the relevant subscription and recover the amount through lawful means.

10. Promotions, loyalty, and referrals

Promotional codes, loyalty rewards, and referral credits are subject to the terms published with each programme: validity period, minimum spend, eligible plans, single use vs. stackable, and similar limits. We may end or change a programme at any time; codes redeemed before the change keep the benefit you already earned.

11. Acceptable use

You agree not to:

  • create accounts using false identity information or another person's details;
  • resell meals or run a competing service from our deliveries;
  • probe, scan, or attempt to gain unauthorised access to our systems, or interfere with other customers' use of the service;
  • abuse our staff. We may suspend or close accounts that send threatening, harassing, or discriminatory messages to our team.

12. Liability

We provide the service with reasonable care. To the extent permitted by Kuwaiti law, our total liability for any claim arising out of a subscription is limited to the amount you paid for that subscription. We are not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot lawfully be excluded under Kuwaiti consumer-protection law.

13. Governing law & language

These Terms are governed by the laws of the State of Kuwait. We will try to resolve any complaint with you directly and in good faith.

These Terms are published in Arabic and English. If the two versions ever appear to disagree, the Arabic version is the controlling text.

14. Changes to these Terms

We may update these Terms as the service evolves. When we make material changes we will update the “Effective” date and notify you in-app or by message where appropriate. Continued use after a change means you accept the updated Terms.
